In our work and in our relations with clients, we are guided by regulatory documents.
There are many of them — each type of service is governed by its own regulations. Below are the key provisions from the public offer agreements:
Payment for a license confirms that you have read and agree to the terms of the public offer agreement. If the license is paid by another person (not the future license owner) or the payment is made through a payment system instead of your settlement account, you must indicate in the payment purpose on whose behalf the payment is made, as well as the identification code of the person for whom the license is purchased.
If this information is not specified in the payment purpose, the license will automatically be issued to the person to whom the invoice was issued.
The company “Torgsoft”, its dealers and representatives grant rights to use the software exclusively under the terms of the License Public Offer Agreement published on torgsoft.ua.
Previously concluded written agreements remain valid only until the moment the public offer is updated on the website. Continued use of the software product constitutes acceptance of the new version of the offer.
Additional options that interact with external services or require ongoing maintenance are provided under a fixed-term license — for a period of 1 year. After the license expires, the right to use and access the functionality of the option is terminated. To continue use, the license must be renewed for another year.
Such fixed-term options include: Mass SMS and e-mail mailing, Bank account statements, Data security: cloud backup, Bank terminal connection, Nova Poshta integration, Excise tax declaration, Visitor tracking, Prom.ua integration, Ukrposhta integration, Rozetka.ua integration, Satu.kz integration, and Software Cash Register (PRRO).
The sale of these options in a perpetual format has been discontinued. Previously purchased perpetual licenses remain valid. Payment for a fixed-term license confirms that the user has read and agrees to the terms set out in this notice published on torgsoft.ua.

Ownership and distribution of the Torgsoft software
The copyright holder of the software product “Computer Program Torgsoft” and the relevant trademarks is Lukashyn Serhii Olehovych. He holds exclusive rights to the following intellectual property objects:

- “Computer Program ‘Torgsoft’” — Certificate No. 28184 dated 31.03.2009, issued by the State Department of Intellectual Property of the Ministry of Education and Science of Ukraine.

Trademarks:
- “Torgsoft uchet zaprosto” — Certificate No. 147481 dated 10.11.2011, issued by the State Intellectual Property Service of Ukraine.
- “Torgsoft” — Certificate No. 147482 dated 10.11.2011.
- “Torgsoft” — Certificate No. 1525692 dated 12.09.2019.
- “Torgsoft” — Certificate No. 1529398 dated 03.03.2020.
The copyright holder grants the right to use the “Computer Program Torgsoft”, as well as the rights to use the relevant trademarks, on the basis of non-exclusive licenses to dealers, representatives, and partners with whom the corresponding license agreements have been concluded. The official list of authorized partners entitled to distribute the Torgsoft software and provide related services is published in the “Dealers” and “Contacts” sections on the official website torgsoft.ua.
Purchase of the “Computer Program Torgsoft” from official dealers, representatives, or partners listed in the “Dealers” and “Contacts” sections on the torgsoft.ua website constitutes acceptance of the license public offer and conclusion of an agreement for use of the software product under the terms established by the copyright holder. Dealers operate on the basis of license agreements that provide for identical conditions of distribution, use, and protection of intellectual property rights.
Any unauthorized use of the software product, its components, trademarks, or other intellectual property objects belonging to Lukashyn Serhii Olehovych constitutes an infringement of intellectual property rights and may result in liability in accordance with applicable law.
