Who can receive compensation for damaged property and how?
25.04.2024 13:22To receive compensation for damaged property from the state, you need to notify the authorities that your home was destroyed or damaged as a result of Russian aggression. In 2024, this can be done in person at the social security authorities or through the Diia portal.
Who is entitled to compensation for damaged or destroyed property?
According to Law No. 2923-IX, a special Commission has been established to consider compensation to citizens for destroyed or damaged property. The following are entitled to monetary compensation from the state:
-
citizens who own damaged real estate, as well as persons who own destroyed apartments or private houses under construction;
-
members of housing cooperatives;
-
co-owners of apartment buildings.
Under the current law, the Cabinet of Ministers may additionally define certain categories of citizens who may be eligible for compensation.
The priority right to monetary compensation is granted:
-
military personnel and combatants, as well as persons who became disabled during their service, and other persons specified in Law No. 3551-XII;
-
citizens of Ukraine who were mobilized in accordance with Presidential Decree No. 65/2022 and Law No. 2105-IX;
-
large families;
-
persons with disabilities of groups I and II.
Individuals cannot receive compensation:
-
against whom sanctions were imposed under Law 1644-VII;
-
persons who have been convicted of crimes recognized as a threat to national security;
-
heirs of the persons mentioned in this list.
What are the types of compensation for damaged property?
The current Law "On Compensation for Damaged and Destroyed Property" defines the following main types of compensation from the state:
-
monetary compensation for the restoration of a private garden or country house;
-
providing a housing certificate for the purchase of new housing. The certificate can be used within 5 years from the date of its receipt. In this case, the person independently searches for and chooses housing. The only restriction is that the selected property must not be located in the temporarily occupied territory or in the area where hostilities are ongoing;
-
compensation in the form of construction work at the site of the damaged property to restore it completely.
It should be noted that a separate application for compensation must be submitted for each damaged or destroyed property. At the same time, the person receiving the compensation must sign an agreement on the assignment of their rights in favor of the state. This is necessary for further claims against the aggressor party for compensation for damages incurred as a result of its armed attack.
One housing certificate is granted for the purchase of only one dwelling.
To receive compensation for a lost apartment or house, you can use the following methods:

Contact CNAP specifically.

Fill out an electronic application through the Diia application.

Submit an application to the social security authorities or through a notary.
How do I get financial assistance from Diia?
The easiest option is to file an application through the Diia app. Such an application is submitted only by the owner of the damaged property. To make an official application, you need to take the following steps:

Log in to the Diia app and go to the Services section.

Select the "Damaged property" section in the main menu.
-
Prepare clear photos of the damaged property and personal contact information.
-
Select the "Start" tab and choose the address of the destroyed property. You can choose from the general list provided or through the "Enter data yourself" tab.

Click the "Next" tab and provide the necessary information about the property, choosing its type: residential premises, apartment or private house.

Specify the total area of the premises.
-
Provide the full address — city, region, district, street, house number.

Assess the damage by choosing from the following options: completely destroyed, unusable, or partially damaged. You must provide information about damage to windows, balconies, walls, or roofs.

Indicate the number of people who have permanently lived in this apartment or house.
-
Provide information if the dwelling has been recognized as a cultural heritage site.

Describe in detail the nature of the damage to the property: the time of the shelling, the conditions under which the damage was caused, and attach 5 photos of the destroyed housing.

Provide personal data, email and contact phone number.

Click "Send".
The electronic application will be immediately sent to a special Commission for consideration. Experts will assess the damage and determine the amount of financial assistance. If the destroyed housing is located in the combat zone or on the temporarily occupied territory, even if such an application for compensation is submitted, the Commission will be established later, after the territory is fully de-occupied. The assessment and compensation procedure is carried out in accordance with CMU Resolution No. 423.
How to apply for compensation for destroyed housing in person?
The procedure for a citizen to apply in person to a social protection authority, a notary or an ASC is the same. The following information must be provided in the application:

surname, name and patronymic of the applicant — the owner of the damaged real estate;
-
passport number and series and identification code;
-
contact details: email and phone number;
-
information from the state register about an apartment or house that was affected by russian aggression;
-
number of residents;
-
information on the nature of the damage and losses.
All of this is primary data that will be reviewed, processed and verified by a special Commission.
What documents do I need to provide to receive compensation?
The application submitted personally by the owner of the damaged housing to the social protection authorities, a notary or an ASC must be attached to the application:
-
A document confirming the ownership of the destroyed real estate.

A document that confirms the investment in the construction of housing that was damaged.
-
A document confirming that the applicant is a member of a housing cooperative (in case of filing an application for damage to cooperative housing).
-
A document confirming the priority right to receive compensation.
Registering a statement about damaged property with the police
After submitting a claim for compensation for housing damage, it is necessary to contact the police and additionally record the destruction. The police must open criminal proceedings in this case in accordance with Article 438 of the Criminal Code and establish the fact of a crime of the Russian Federation against the applicant's property. The relevant application can be filed at any police department.
The application must be accompanied by originals and photocopies of documents confirming ownership of the property, as well as photographs of the damage. The next step is to obtain an extract from the Unified State Register stating that the damage to the property has been officially registered.
If the Commission makes a positive decision, the owner of the damaged property will receive money or a housing certificate in accordance with the procedure established by the current Law.
