How an employer can get UAH 6500 for employing IDPs
23.03.2022 18:14The Cabinet of Ministers of Ukraine approved Resolution No. 331 dated 20.03.2022 "On Approval of the Procedure for Providing Employers with Compensation for Labor Costs for Employment of Internally Displaced Persons as a Result of Hostilities During Martial Law in Ukraine".
To encourage employers to hire internally displaced persons, the government will compensate labor costs in the amount of UAH 6,500.
- to be registered with the regulatory authorities as a payer of the Single Social Contribution,
- the amount of an employee's salary for the month must not be lower than the statutory minimum wage,
- the employer must submit tax returns for the 4th quarter of 2021 or financial statements for 2021.
Compensation in the amount of UAH 6,500 will be provided for each employed displaced person, regardless of the type of employment contract: fixed-term, indefinite, or gig contract. It does not matter whether it is a full-time or part-time job.
UAH 6,500 will be paid monthly for each employed person, subject to the payment of the unified social contribution for such an employee. The term of such payments: during the martial law and 30 calendar days after the end of martial law, but not more than two months from the date of employment of such person.
In order to receive compensation, the employer must apply to the employment center at the employer's location with an application for compensation for expenses no earlier than five days after the employee is hired.
The application can be submitted:
- electronically 一 through the Unified State Web Portal of Electronic Services (Diia Portal),
- in paper form 一 by personally visiting the Employment Center or by sending a letter to the relevant authority's e-mail. The paper application form is approved by the Employment Center.
A paper application sent by e-mail must be attached to the application:
- a copy of the order on employment of IDPs,
- a copy of the employee's passport and TIN,
- a copy of the IDP registration certificate.
To submit an application using the Diia portal, you must:
- log in to the portal using an electronic key,
- fill out, sign and send the relevant application.
After receiving the application, the STS transmits the information to the Pension Fund. The Pension Fund verifies the data, then generates and submits information on insured persons who meet the specified criteria to the Ministry of Digital Transformation. The Ministry of Digital Transformation then submits to the Employment Center the lists of employers to whom payments are to be made.
The Employment Center makes a decision on granting or denying the payment within 5 days from the date of receipt of the paper application. In case of a positive decision, the Employment Center transfers the funds to the employer's account within five days after the decision is made.
If the employment relationship is terminated before the end of the compensation period, the employer must return the amount of unused compensation to the Employment Center's account. To receive compensation for the second month of an IDP's work, the employer must submit a new application in paper or electronic format.
The employer and employee are responsible for the accuracy of the data provided. In case of inaccuracies, the employer must return the amount of compensation received voluntarily or by court order.
