On January 1, 2022, the Law No. 1946-IX dated December 14, 2021 came into force. This law is designed for IT companies that are residents of Diya City and regulates the employment of gig specialists. The law provides for informing tax authorities about the conclusion of gig contracts. To this end, changes have been made to the Employee Notification Form.
The form for Employee Notification is now called "Employee Notification/Signing of Gig Contract".
In addition to the name of the form, changes were made to its content. A new column "7. Unique record number in the Unified State Demographic Register (if available)" was added to the table section of the form. This field is filled in if the employee or gig specialist has biometric documents (ID card or biometric foreign passport). Data from the "Record №" field should be copied. If the person has a booklet passport, this column does not need to be filled.
Also, in column "5. Category of person", the categories of persons were changed. Previously, it was necessary to put either 1 or 2, depending on whether the employee had a work book. Now, four categories have been developed for this field:

  1. Employees at the main place of work.
  2. Employees with secondary jobs (previously identified as employees without a work book).
  3. Gig specialists under a gig contract.
  4. Employees under a civil contract.

The State Labor Department in the Odessa region has provided clarification on who the employers should notify.

  • Employers (individual entrepreneurs and legal entities) must notify about hiring employees for their main work place and secondary employment under an employment contract. Thus, these employers notify about the first and second categories of people.
  • Employers (IT companies) that are Diya City residents must notify about the signing of gig contracts or engaging specialists under a civil contract. Thus, these employers notify about the third and fourth categories of people.

Conclusion. If the employer is an individual entrepreneur or a legal entity that signs a civil contract, they do not need to submit the "Employee Notification/Signing of Gig Contract". Such notifications are only submitted by Diya City residents.
Remember. Notifications about hiring an employee must be submitted before the actual starting date.
In addition to the changes to the form, changes have also been made to the procedure for its submission. Now the Notification can be submitted in two ways: electronically using electronic communication tools with a digital signature or in paper form, but a copy must be added electronically.
At the time of writing this article (January 2020), the new form of the Notification has not yet appeared. The tax authorities recommend submitting the Notification in the old form and promise to release the update by 01.02.2022.
